If you are uncertain whether alimony or spousal support is appropriate, I will work with you to identify and analyze the key factors that the court considers:

  • Disparity of income between spouses
  • Earning ability of each spouse: A party may have the capacity to earn (based on education or other factors) even though he or she has not been employed
  • Length of the marriage. Courts are more inclined to award alimony the longer parties have been married
  • Retirement assets of each party
  • Health and age of each party, as it relates to earning ability and the length of support obligations
  • Contribution by one spouse to the other in attaining education or a professional degree

Unlike child support, spousal support is not based on a formula. It is entirely discretionary with the court. The court may or may not choose to award alimony and the decision is dynamic, based on an overall evaluation of the particulars of each case.
